Reading the problem question

Your first step should be to read through the moot problem.

This video takes you through a typical analysis of a problem question. 

 

  • Brainstorm the legal issues and obvious policy arguments.
  • Avoid confining yourself to just your client’s case - the idea is to identify issues raised generally.
  • Research any basic legal areas you might be unsure about.
  • After generally thinking about the problem, the next step is strategy. The problem has likely already identified the issues on appeal.
